Nexios Media Garmin App Terms of Use

Effective date: March 13, 2026

These Terms of Use govern your use of the Nexios Media Garmin-compatible application (the "App") made available by Nexios Media LLC ("Nexios Media," "we," "us," or "our"). By downloading, installing, or using the App, you agree to these terms.

1. License

Subject to these terms, Nexios Media grants you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use on compatible Garmin devices and related platforms.

2. Acceptable Use

You agree not to misuse the App, interfere with its normal operation, reverse engineer it except where allowed by law, or use it in a way that violates applicable law, Garmin platform rules, or the rights of others.

3. Health and Activity Disclaimer

The App may display activity, wellness, or workout-related information, but it is not a medical device and does not provide medical advice, diagnosis, or treatment. Do not rely on the App for emergency, safety-critical, or clinical decisions. You are responsible for exercising safely and consulting a qualified professional when appropriate.

4. User Responsibility

  • You are responsible for the accuracy of the information you choose to provide or authorize through the Garmin platform.
  • You are responsible for reviewing your Garmin permissions and device settings.
  • You are responsible for maintaining the security of your own devices and accounts.

5. Third-Party Platforms

The App runs on Garmin hardware, software, and services that we do not control. Your use of Garmin services is also subject to Garmin's own terms, policies, and availability. Nexios Media is not responsible for third-party platform outages, changes, or restrictions.

6. Privacy

Your use of the App is also subject to our Privacy Policy, which explains how activity data and other information may be used and disclosed.

7. Updates and Changes

We may release updates, bug fixes, or feature changes at any time. We may also update these Terms of Use from time to time. Continued use of the App after updated terms are posted constitutes acceptance of the revised terms.

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXIOS MEDIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
